Blossom Group LLC shall not be liable for any errors or delays regarding an order, or for any actions taken in reliance thereon. Buyer agrees to indemnify and hold harmless Blossom Group LLC, its employees, agents, successors, officers, and assigns, from and against any suits, losses, claims, demands, liabilities, costs, and expenses (including attorney and accounting fees) that Blossom Group LLC may sustain or incur as a result of any claim against it based upon negligence, breach of warranty, strict liability in tort, contract, or any other theory of law brought by Buyer, its officers, agents, employees, successors or assigns, by Buyer's customers, by end users, by auxiliary personnel (such as freight handlers, etc.) or by other third parties, arising out of, directly or indirectly, the use of Blossom Group LLC products, or by reason of Buyer's failure to perform its obligations contained herein.
At buyer's request, Blossom Group LLC may, at its own discretion, supply technical assistance and information with respect to products. Blossom Group LLC makes no warranties of any kind or nature – expressed or implied – including any implied warranty of merchantability or fitness for any particular purpose, with respect to technical assistance or information provided by Blossom Group LLC or its personnel. Any suggestions by Blossom Group LLC regarding use, selection, application, or suitability of the products shall not be construed as an express warranty, unless specifically designated as such in writing and signed by an officer or other authorized representative of Blossom Group LLC.
Further, Blossom Group LLC is not responsible for the comments made in the customer reviews/Reviews, nor when products are used in ways not suitable to their purpose (for example, fragrance oils in toothpaste; bath salts in metal containers; additives used in larger amounts than recommended).
As with any manufacturing process, Blossom Group LLC strongly recommends small lab scale testing for evaluation purposes, prior to full commercial manufacturing. As the ordinary or otherwise use(s) of this product is outside the control of Blossom Group LLC, no representation or warranty – expressed or implied – is made as to the effect(s) of such use(s) (including damage or injury) or the results obtained.
The liability of Blossom Group LLC is limited to the value of the goods and does not include any consequential loss. Blossom Group LLC shall not in any event be liable for incidental, consequential or special damages of any kind resulting from any use or failure of the products, even if Blossom Group LLC has been advised of the possibility of such damage including, without limitation, liability for loss of use, loss of work in progress, down time, loss of revenue or profits, failure to realize savings, loss of products of buyer or other use or any liability of buyer to a third party on account of such loss, or for any labor or any other expense, damage or loss occasioned by such product including personal injury or property damage.
Please note, the International Federation of Aromatherapists do not recommend that Essential Oils be taken internally, unless under the supervision of a Medical Doctor, who is also qualified in clinical Aromatherapy. In addition, Essential Oils must be properly diluted before use, in order to avoid any damages to property or adverse physical effects (including injury or bodily harm). In the event of any dispute, the Customer hereby agree that Jurisdiction is limited to the State of Illinois, USA.
